Terms of Service

These Terms of Service ("Terms") govern your access to and use of the TastePapa mobile application, website, support forms, and related services (the "Service"), provided by TastePapa ("we", "us", "our"). By creating an account, purchasing a subscription, or using the Service, you agree to these Terms.

1. Eligibility

You must be at least 13 years old to use the Service. If you are between 13 and the age of majority in your jurisdiction, you represent that a parent or legal guardian has reviewed and accepted these Terms on your behalf.

2. Accounts and Security

You may use some features without an account, but signed-in accounts enable sync and account recovery. You may register using Apple Sign In, Google Sign In, or email and password. You are responsible for your account credentials and for activity under your account. Notify us promptly if you suspect unauthorized access.

3. TastePapa Pro and Subscriptions

The Service offers an optional paid subscription, TastePapa Pro. Pricing, billing period, trial availability, renewal terms, and included features are shown in the app before purchase. Subscriptions are billed through Apple App Store or Google Play and renew automatically until canceled. The TastePapa Subscription Terms form part of these Terms.

4. AI and Assistant Features

TastePapa includes AI-assisted features such as recipe generation, recipe chat, Ask Papa, social and web imports, OCR/image extraction, translation, nutrition estimates, meal planning, prep guides, and grocery/kitchen suggestions. Ask Papa may also help perform actions you request, such as adding grocery items, adjusting meal plans, or updating kitchen lists.

AI output and assistant actions may be inaccurate, incomplete, delayed, or unsuitable for your needs. You are responsible for reviewing all recipes, ingredients, allergens, substitutions, cooking steps, temperatures, nutrition, grocery changes, and meal-plan changes before relying on them. TastePapa does not provide medical, nutrition, dietetic, allergy, or food-safety advice.

5. Food Safety and Health

TastePapa is a planning and cooking aid. You are responsible for using safe food handling practices, checking expiration dates, cooking foods to safe temperatures, avoiding allergens, and deciding whether recipes fit your dietary or medical needs. Nutrition values, calories, freshness hints, and dietary labels are estimates only.

6. User Content

You retain ownership of recipes, photos, lists, notes, meal plans, imports, and other content you submit ("User Content"). You grant us a limited, non-exclusive, royalty-free license to host, store, process, sync, translate, display, and otherwise use your User Content only as needed to operate, secure, troubleshoot, and improve the Service for you. We do not use your private User Content to train third-party AI models.

7. Imported and Third-Party Content

When you import recipes or content from websites, Instagram, TikTok, Photos, Files, or other sources, you represent that you have the right to submit and save that content for your personal use. TastePapa is not affiliated with Instagram, TikTok, or other third-party platforms and is not responsible for third-party content, platform availability, or third-party terms.

8. Acceptable Use

You agree that you will not:

• Use the Service for unlawful, harmful, abusive, infringing, or unsafe purposes.
• Bypass rate limits, quotas, App Check, subscriptions, paywalls, or security controls.
• Reverse engineer, decompile, scrape, or extract source code, prompts, model behavior, or non-public data from the Service.
• Upload malicious files, automated requests, prompt-injection payloads, or content intended to disrupt the Service or third-party services.
• Use the Service to train or build a competing product or AI model.
• Misrepresent your rights to content imported from third-party sources.

9. Service Availability, Sync, and Data

We work to keep TastePapa reliable, but the Service may be unavailable, delayed, or interrupted. AI providers, app stores, hosting, network connectivity, and third-party platforms may fail or change. Offline and sync features are best-effort and may produce conflicts, duplicate entries, or delayed updates. You should review important data and keep your own backup of content that matters to you.

10. Intellectual Property

The Service, including software, design, branding, logos, documentation, and content provided by us, belongs to TastePapa or its licensors. These Terms do not grant rights to our trademarks, branding, or proprietary technology.

11. Termination and Account Deletion

We may suspend or terminate access if you violate these Terms, create risk for users or the Service, abuse free tiers, or use the Service in a way that may cause legal or operational harm. You may delete your account in Settings > Account > Delete account or follow the instructions on our account deletion page. Deleting the app or your TastePapa account does not cancel an app-store subscription.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and reliability, including for AI-generated content, nutrition estimates, imports, sync, and assistant actions, to the fullest extent permitted by law.

13. Limitation of Liability

To the fullest extent permitted by law, TastePapa will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, food-related harm, subscription platform issues, third-party content, or reliance on AI output. Our aggregate liability for any claim will not exceed the greater of (a) the amount you paid for the Service in the twelve (12) months before the claim, or (b) USD $100.

14. Indemnification

You agree to indemnify and hold harmless TastePapa from claims, damages, liabilities, and expenses arising from your User Content, imported content, misuse of the Service, violation of these Terms, or violation of another person's rights.

15. Governing Law

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-laws principles. Disputes shall be resolved in the state or federal courts located in Texas, and you consent to personal jurisdiction in those courts, except where applicable law requires otherwise.

16. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated through the app, website, or email. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
